Terms of Service

1. Acceptance of Terms

By accessing or using EyeSights ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

EyeSights is a social media content management platform. Our Service provides:

  • AI-generated social media content tailored to your business
  • Content scheduling and calendar management
  • Multi-platform publishing to Instagram, Facebook, WordPress, and Google Business Profile
  • Brand management and customization tools
  • Analytics and engagement tracking
  • Content approval workflows

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old and have the legal authority to bind your organization to these Terms.

4. Third-Party Platform Integrations

4.1 Social Media Connections

Our Service integrates with third-party platforms including Meta (Facebook/Instagram), WordPress, and Google (Google Business Profile, Search Console). By connecting these platforms, you:

  • Authorize EyeSights to access your accounts on these platforms
  • Grant permission to publish content on your behalf
  • Acknowledge that your use of these platforms is also subject to their respective terms of service
  • Accept responsibility for ensuring your content complies with each platform's policies

4.2 Google API Services

EyeSights uses Google API Services, including the Google Business Profile API. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Google Business Profile Data Usage:

  • We access your Google Business Profile to publish posts and updates on your behalf
  • We collect location information to identify which business locations you want to manage
  • We store access tokens securely to maintain your connection
  • We retrieve analytics data (views, clicks, engagement) to display in your dashboard
  • We do not share your Google data with third parties except as necessary to provide the Service
  • You can disconnect your Google account at any time through your account settings

4.3 Meta (Facebook/Instagram) Integration

When you connect your Facebook or Instagram accounts:

  • We access your business pages and Instagram professional accounts
  • We publish content and retrieve engagement metrics on your behalf
  • We comply with Meta's Platform Terms and Developer Policies

5. User Content

5.1 Your Content

You retain ownership of all content you upload, create, or submit through the Service ("User Content"). By using the Service, you grant EyeSights a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of providing the Service.

5.2 AI-Generated Content

Content generated by our AI tools is provided for your use in managing your social media presence. Scheduled posts and blog articles are placed in your review queue, where you can approve or reject them for as long as their review period is open. Editing stays available longer: you can change an item until shortly before its scheduled publishing time, when it locks.

Content you do not review may still publish. Each item we schedule for you carries a review period, and we email you reminders before it ends. If you have not acted on such an item by the end of its review period, it is approved automatically and published on schedule. That is deliberate — it is what keeps your accounts posting during a busy week — but it means reviewing your queue is your responsibility, not an optional step, and content you never looked at can go out under your name. Rejecting is only possible while the review period is open — once an item has been approved, automatically or by you, it is queued to publish and rejecting it is no longer available to you. You can turn off publishing for any channel from your settings at any time, and you can ask us to pull an approved post.

Replies to reviews work differently and do not go through the queue. On plans that include automatic review responses, we may generate and post a reply to a positive review directly on your listing without asking you first. Replies to negative reviews are never posted automatically — we draft them and notify you, and posting is your decision. You can switch automatic review responses off at any time in your settings.

EyeSights does not guarantee that AI-generated content will be error-free, appropriate for all contexts, or compliant with all regulations.

5.3 Content Restrictions

You agree not to upload or publish content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains false or misleading claims
  • Is defamatory, obscene, or harmful
  • Violates the terms of connected social media platforms

6. Subscription and Payment

6.1 Subscription Plans

Access to certain features requires a paid subscription. Subscription details, including pricing and features, are available on our website and in your account dashboard.

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

6.4 Free Plan and Paid-Plan Trial

There are two different things on this site called a “trial,” and they bill differently. Read both before you start.

  • Free plan. Creating an account gives you a limited monthly allowance at no cost. You are not asked for a card, and we will not move you to a paid plan automatically.
  • 14-day paid-plan trial. Starting a paid plan requires a valid payment method up front. Your card is not charged during the 14-day trial, but the trial converts to a paid subscription automatically at the end of the 14 days and your card is charged the plan price then, unless you cancel before the trial ends. Cancelling during the trial costs nothing.

You can cancel a trial at any time from your account settings. We send a reminder before a trial converts, but it is your responsibility to cancel if you do not wish to be charged.

7. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by EyeSights and is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

7.1 Websites We Build For You

If you purchase the Website Builder add-on, the following applies to the site we build:

  • Your domain is yours. Your domain name is registered in your name and remains your property whether or not you remain a customer. If we registered it on your behalf, we will transfer it to a registrar account you control on request.
  • Your content and brand are yours. Text, images, logos, and other material you supply remain yours. On payment of the setup fee you receive a perpetual, non-exclusive licence to use the design and page markup we produce for your site.
  • Our platform stays ours. The generator, templates, portal, and underlying tooling remain our property. Third-party assets we license on your behalf (stock photography, fonts) remain subject to their own licences.
  • What you get back. On request, at cancellation or at any other time, we will provide the static files of your live site — HTML, CSS, JavaScript, and images — so you can host them elsewhere. We aim to deliver these within 14 days of your request. This is a manual handover, not a self-service download.
  • What stops working. Some parts of your site are powered by the Service and stop when your subscription ends: automatic blog publishing, the analytics and conversion tracking script, contact-form delivery and spam filtering, and the monthly SEO analyst. The static pages themselves continue to work once hosted elsewhere. You can disconnect any account at any time from your settings, and you may ask us to delete the credentials we hold for your connected accounts.

Post-launch change requests are included up to a set number per calendar month; the allowance resets on the 1st and unused requests do not roll over. The number included with each plan, and the fee for requests beyond it, are set out on our website pricing page and in your order. Requests beyond the allowance are added as a separate line on your next invoice.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • AI-generated content will be accurate, complete, or suitable for your needs
  • Third-party platform integrations will always function correctly
  • The Service will meet all regulatory requirements for your business

You are responsible for ensuring your use of the Service complies with applicable laws and regulations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYESIGHTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Reputational harm
  • Damages resulting from third-party platform changes or outages

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EyeSights, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your User Content
  • Your violation of any rights of another party

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions that should survive termination (including intellectual property, disclaimers, limitations of liability) will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EyeSights regarding the Service and supersede any prior agreements.
